Your trust is the foundation of every clinical workflow we power. This Privacy Policy explains what we collect, how we use it, and the rights you have over your information.

Who this policy applies to

This Privacy Policy explains how Floggats LLC, operating as NexiumCare ("NexiumCare", "we", "us"), collects, uses, and shares information about visitors to our website and individuals who interact with our marketing, sales, and customer support channels.

Protected health information (PHI) that healthcare practices store, transmit, or receive through NexiumCare as part of providing care is governed by the Business Associate Agreement (BAA) we sign with each practice — not by this Privacy Policy. Our handling of PHI is governed by HIPAA and the BAA, and we act as a business associate of the practice (the covered entity).

Information we collect

We collect information in three ways:

  • Information you give us — name, email, practice name, phone number, role, and other details you provide when you sign up for a trial, request a demo, contact support, or subscribe to our newsletter.
  • Information collected automatically — IP address, browser type, device identifiers, pages viewed, referring URL, and similar telemetry collected via cookies and analytics tools.
  • Information from third parties — limited business information from data enrichment partners (e.g., specialty, practice size) used to qualify leads and personalize outreach.

How we use information

We use the information we collect to:

  • Provide and operate the NexiumCare website and customer accounts.
  • Respond to inquiries, schedule demos, and provide customer support.
  • Send transactional communications (account, billing, security notices).
  • Send marketing communications you have opted into; you can unsubscribe at any time.
  • Improve the website, our products, and customer experience.
  • Detect, investigate, and prevent fraud, abuse, and security incidents.
  • Comply with our legal and contractual obligations.

SMS / text messaging

With your consent, NexiumCare and the practices that use NexiumCare may send you SMS text messages — for example appointment reminders and confirmations, care or billing notifications, and account or security alerts. You opt in by providing a mobile number and agreeing to receive text messages (for example when booking, registering, or in your account settings); a practice may also collect this consent from its patients directly.

  • We do not sell or share your mobile number. Mobile phone numbers and SMS opt-in consent are never sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.
  • Message frequency variesbased on your and your practice's activity.
  • Message and data rates may apply, depending on your mobile carrier and plan.
  • Opt out at any time by replying STOP to any message; reply HELP for help. You can also contact us at [email protected].
  • Carriers are not liable for delayed or undelivered messages.

When we share information

We do not sell your information. We share information only in these circumstances:

  • Subprocessors who provide services on our behalf (hosting, email delivery, analytics, customer support tooling, payments). Each subprocessor is contractually bound to protect your information. A current list of subprocessors is available on request.
  • Affiliates within the NexiumCare corporate family, subject to this Privacy Policy.
  • Compliance and legal process when required to do so by law or by a valid legal request, and to protect the rights, safety, or property of NexiumCare or others.
  • Business transactions in the event of a merger, acquisition, financing, or sale of company assets. We will notify you before your information becomes subject to a different privacy policy.

Cookies and tracking

We use first-party and third-party cookies for required functionality (session management, security, preferences), analytics (understanding website performance and visitor behavior), and marketing (showing relevant ads and measuring their effectiveness).

You can manage cookie preferences via the cookie banner on our site or your browser settings. Disabling required cookies may affect site functionality.

Your rights

Depending on where you live, you may have the right to:

  • Access the personal information we hold about you.
  • Correct inaccurate or incomplete information.
  • Delete your information, subject to limited legal exceptions.
  • Object to or restrict certain processing.
  • Receive a portable copy of your information.
  • Withdraw consent for processing based on consent.
  • Opt out of the sale or sharing of your information (NexiumCare does not sell personal information).

How long we keep information

We keep marketing and account information for as long as necessary to provide the services and meet our legal obligations. Marketing data tied to inactive contacts is reviewed and pruned annually. PHI retention is governed by the BAA and the practice's instructions.

International data transfers

NexiumCare is based in the United States, and information is processed primarily on servers in the US. For EU-based practices, we provide a Data Processing Addendum incorporating Standard Contractual Clauses. See our Data Processing Addendum for details.

Security

We use administrative, technical, and physical safeguards designed to protect your information, including encryption in transit and at rest, access controls, and continuous monitoring. See the Security & Compliance page for the full control set.

Children's privacy

Our website is not directed to children under 13. We do not knowingly collect personal information from children. If you believe a child has provided information to us, contact [email protected] and we will delete it.

Changes to this policy

We may update this Privacy Policy from time to time. Material changes will be posted on this page with a new Effective date and, where appropriate, communicated by email or in-product notice.
